Eva Klempert, LL.M., has acquired her professional title “lawyer” in Germany and is registered there and belongs to the Düsseldorf Bar Association, Freiligrathstr. 25, 40479 Düsseldorf. She acquired the title “LL.M.” (Master of Laws / magister legum) at the University of London, UK.
Lawyers in Germany are subject to the professional regulations of the Federal Lawyers´ Act (Bundesrechtsanwaltsordnung, BRAO), the Lawyer Remuneration Law (Rechtsanwaltsvergütungsgesetz, RVG), the Rules for Professional Practice (Berufsordnung für Rechtsanwälte, BORA), the Code of Conduct for European Lawyers (CCBE). These regulations are available in English and German on the website of the Federal Law Society (www.brak.de) in the heading “for lawyers” in section "professional law”.
The legal services are moreover performed in accordance with the regulations of the mandate contracts and remuneration agreements that are concluded individually with the clients. According to the professional rules, the pursuance of conflicting interests is prohibited for lawyers, therefore a conflict of interests is reviewed prior to accepting a mandate.
The professional liability insurance is HDI Versicherung AG, HDI-Platz 1, 30659 Hannover. The geographic scope of the insurance contract covers (1.) Germany, (2.) other European countries: (a) The insurance covers liability claims arising from activities (a) in connection with advice and employment under European law; (b) the lawyer before European Courts, (3.) worldwide to an amount of the legally prescribed minimum insurance sum for liability claims arising from a claim against the policyholder before non-European courts. (4.) The insurance does not apply to liability claims that arise from activities via law firms or offices established or maintained abroad.

In the event of conflict between members of the German bar associations and their clients the possibility of an out-of-court conciliation (§ 191 f BRAO) exists at the Lawyers´ Arbitration Board, Rauchstr. 26, 10787 Berlin, Website: www.s-d-r.org. This law firm declares its willingness to participate in a conciliation procedure at the Lawyers´ Arbitration Board.
